Terms of Service

These Terms are the contract between you and ResumeCaliper for using the AI CV analysis service. Please read them together with the Privacy Policy.

Last updated: 24 September 2026 (version 2026-09-24). If you are a consumer, nothing in these Terms limits the rights you have under the mandatory consumer-protection law of the country where you live. Where these Terms are translated, the English version prevails in case of doubt, except where mandatory law requires otherwise.

1. Who operates ResumeCaliper and how these Terms apply

ResumeCaliper is operated by Arseniy Rusentsov, a self-employed professional (autónomo) established in Spain, registered address Placa Catalana 1, 1-4, 08032 Barcelona, Spain, NIF Z0402379E, e-mail [email protected]. Full identification is on the Legal notice.

By creating an account, running an analysis or buying a package you accept these Terms and confirm that you have read the Privacy Policy, the Cookies policy and the AI transparency notice. If you do not agree, do not use the service. ResumeCaliper records the version of the Terms you accepted and when.

3. Eligibility

You must be at least 18 years old (or the age of majority where you live) and able to enter into a binding contract. The Service is intended for private individuals working on their own job applications ("consumers"). If you use it on behalf of a business, you confirm that you are authorised to bind that business.

4. Your account

You can create an account and sign in with an email address and password, or with a Google account, both through Firebase Authentication. You are responsible for keeping your credentials (and, if you use Google sign-in, your Google account) secure and for everything done through your ResumeCaliper account. Keep one account per person. Tell the operator at [email protected] if you believe your account has been misused. You can delete your account at any time under Privacy & data in the app.

5. The Service and what it is not

ResumeCaliper uses an artificial-intelligence system to estimate how well your own CV matches a job description, to suggest improvements and, on request, to draft a tailored CV and cover letter. You are informed that you are interacting with an AI system and that Outputs are AI-generated (EU AI Act, Art. 50).

Art. 50(2) PDF marking. AI-drafted cover letter PDFs carry a machine-readable marker in their metadata identifying them as AI-generated (new synthetic text). The improved CV is an AI-assisted rewrite of your own source CV using only facts you provided — not a document invented from scratch — so ResumeCaliper does not apply that same Art. 50(2) PDF metadata marker to CV downloads. Both remain AI Outputs you must review; the distinction is only about the machine-readable PDF marker. Details: AI transparency and Privacy Policy §5.

This is a personal optimisation tool for candidates. The Service does not make employment decisions, nor does it guarantee or influence hiring processes by employers. Scores and drafts are shown only to you, as decision support for your own job search.

The Service:

AI Outputs can contain errors, omissions or bias. The model is instructed to use only facts from your source CV, but you must review every line before you use it and you are responsible for the truthfulness of what you send to an employer.

6. Free tier

ResumeCaliper may offer a limited number of free Checks. Free Checks may be subject to a waiting period between runs and to a short first-party unlock step (a countdown timer or bot check operated by ResumeCaliper, not third-party advertising). If you have accepted ads in the cookie notice, display advertising may be shown; rejecting ads does not block the free tier. ResumeCaliper may change or withdraw the free tier at any time.

7. Packages, prices and payment

Packages. The current Packages, the number of Checks they contain and their validity period are shown on the Pricing page and in the app at the time of purchase (for example a Trial pack valid for 7 days and a Monthly pack valid for 30 days). One Check is consumed when an analysis run starts; the improved CV and cover letter for that run are included in the same Check.

Prices. Prices are shown for your region and currency. List prices exclude VAT and are labelled as such on Pricing and in Billing. The amount charged at Stripe Checkout for the Package equals that listed price. Where VAT must be charged in addition, the total including VAT is displayed at checkout before you confirm the purchase. ResumeCaliper may change prices with effect for future purchases only. Whether Spanish or EU VAT registration (for example VAT OSS) is required for a given sale is an operator tax matter separate from this display rule.

Payment. Payments are processed by Stripe on Stripe's hosted checkout page. ResumeCaliper never receives or stores your full card number. Packages are credited to your account when Stripe confirms the payment. You will receive a receipt by e-mail from Stripe; ask the operator at [email protected] if you need an invoice.

Validity and expiry. Checks are valid only during the Package's validity period and are for your own use. Unused Checks expire at the end of that period and are not refunded, except as provided in section 8 or by mandatory law. Checks are not transferable and cannot be exchanged for cash.

8. Immediate performance, withdrawal waiver and unused-credit refunds (EU/EEA consumers)

A Check is a digital service that is performed immediately when you run it. Before you buy a Package the app requires a checkbox in which you expressly request that the Service start during the statutory withdrawal period and acknowledge that you lose the 14-day right of withdrawal for that Package purchase (Directive 2011/83/EU; Spanish TRLGDCU). Without that acknowledgment ResumeCaliper cannot start the paid Service until the withdrawal period has expired.

Effect of the checkbox. When you confirm it (the normal purchase path), the 14-day right of withdrawal for that Package does not apply. ResumeCaliper does not operate a separate 14-day “returns” window for waived purchases. A plain-language summary of remaining refund rules is in the Refunds policy.

When a monetary refund of unused Checks is still due (for example where ResumeCaliper materially reduces what a current Package offers, terminates your account because of ResumeCaliper’s own breach, or where mandatory law requires a remedy), the refund is calculated as:

Package price paid − (used Checks × base price per Check), never below zero,

where used Checks are Checks already consumed from that Package, and base price per Check is the list price of the base (Trial) Package for your region and currency divided by the number of Checks in that Trial Package (as shown on Pricing / in Billing). Unused Checks that expire with the Package validity period are not refunded.

Where mandatory law in your country still requires a withdrawal remedy despite the acknowledgment, contact [email protected]; any monetary refund of remaining Checks uses the same unused-credit formula. The model form in the Annex is provided only for that residual mandatory-law case.

9. Conformity of the digital service (consumers)

If you are a consumer, you are entitled to a Service that conforms to the contract and to these Terms under Directive (EU) 2019/770 and the Spanish consumer code (Royal Legislative Decree 1/2007), including the statutory remedies (bringing the Service into conformity, a proportionate price reduction or termination) if it does not. The AI nature of the Service means that Outputs are estimates and drafts, as described in section 5; an Output that you disagree with is not, by itself, a lack of conformity. If a Check fails for technical reasons, the Check is released back to your account automatically or on request.

10. Acceptable use

You must not:

ResumeCaliper may stop an analysis, remove content, suspend or close an account that breaches this section, giving notice where reasonably possible. Credits consumed by abusive use are not refunded.

11. Your content, Outputs and intellectual property

You keep all rights in the CVs, job descriptions, notes and photos you upload. You grant ResumeCaliper a non-exclusive, worldwide, royalty-free licence to process them only to fulfil your request (run the Check you started, including sending anonymised text to the AI provider) and for the retention periods in the Privacy Policy. ResumeCaliper does not use your content to train AI models, for advertising, for profiling you beyond providing that Check, or for any other purpose. Processing inputs such as anonymised CV text are deleted when the run finishes; downloadable Outputs follow the one-shot and time limits in the Privacy Policy.

To the extent ResumeCaliper holds any rights in the Outputs generated for you, those rights are assigned to you, or, where assignment is not possible, you are granted a perpetual licence to use them for any purpose. Because Outputs are AI-generated and derived from your own materials, ResumeCaliper does not guarantee that they are original or that they qualify for copyright protection, and similar Outputs may be generated for other users from similar inputs.

The Service itself — software, design, prompts, brand and website content — remains the property of ResumeCaliper or its licensors. You may not copy, resell or make the Service available to third parties.

12. Third-party services

The Service depends on providers such as OpenAI (AI processing), Google / Firebase (authentication — email and password, and optional Google sign-in), Stripe (payments), Cloudflare (network security) and Contabo (hosting), as described in the Privacy Policy. Their outages or changes may affect the Service; ResumeCaliper acts reasonably to maintain availability but cannot guarantee it. Stripe's own terms apply to the checkout page, and Google's terms apply when you use Google sign-in.

13. Availability, changes and termination

ResumeCaliper may update, change or discontinue features, including the models used, as the product evolves, and may interrupt the Service for maintenance or security. Reasonable notice will be given of changes that materially reduce what a current Package offers, and consumers may end the contract and receive a refund of unused Checks of the affected Package calculated as in section 8 in that case.

You may stop using the Service and delete your account at any time. ResumeCaliper may suspend or terminate accounts that breach these Terms or pose a security or legal risk, giving notice where reasonably possible. On termination your right to use remaining Checks ends, except where the termination is caused by a breach by ResumeCaliper, in which case unused Checks are refunded as in section 8.

14. Warranties and liability

The Service is provided with the care that can reasonably be expected of a small online service. Except as expressly stated in these Terms or required by mandatory law, ResumeCaliper does not give warranties about the accuracy or completeness of Outputs or about their suitability for a particular job application.

To the extent permitted by law: ResumeCaliper's total liability for all claims arising from your use of the Service in any 12-month period is limited to the amount you paid to ResumeCaliper in that period (or EUR 50 if you paid nothing); and ResumeCaliper is not liable for indirect or consequential loss, including lost job opportunities, lost income or lost profits.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or wilful misconduct, for gross negligence, or for anything that cannot be excluded or limited under the law that applies to you, including consumer-protection law.

15. Complaints and dispute resolution

Write to [email protected] or use the Contact page; ResumeCaliper replies as soon as reasonably possible and in any case within one month. Consumers in Spain may also request an official complaint form (hoja de reclamaciones / full oficial de reclamació) and contact their local consumer office (OMIC) or the Catalan Consumer Agency. ResumeCaliper is not currently adhered to any alternative dispute resolution (ADR) body and is not obliged to take part in ADR proceedings; where the law requires it, ResumeCaliper will inform you of any competent ADR entity in its reply. The European Commission's online dispute resolution platform has been discontinued and is no longer available.

16. Governing law and jurisdiction

These Terms are governed by Spanish law. If you are a consumer resident in the EU/EEA, you also enjoy the protection of the mandatory rules of the law of your country of residence, and you may bring proceedings either in the courts of that country or in Spain. ResumeCaliper may bring proceedings against a consumer only in the courts of the consumer's country of residence.

17. Changes to these Terms

ResumeCaliper may update these Terms when the Service, the law or its providers change. The new version will be published with its date and, for material changes, you will be told in the app or by e-mail at least 15 days before they take effect. If you do not accept a material change you may delete your account before it takes effect, and any unused Checks of a Package bought under the previous Terms will be refunded as in section 8. Continuing to use the Service after the effective date means you accept the new Terms.

18. General

If any part of these Terms is found invalid, the rest remains in force. ResumeCaliper may transfer this contract to a successor of the business with notice to you; your rights are not reduced by that transfer. These Terms, the Privacy Policy, the Cookies policy and the AI transparency notice form the entire agreement between you and ResumeCaliper regarding the Service.
